Position Overview: We are seeking a motivated and skilled Law Clerk interested in being trained in these areas of law or a licensed Attorney who is excited to join our growing team. The ideal candidate will have a strong desire to handle contested probate matters and provide exceptional legal services to our clients. This is a full-time position with flexible working hours and opportunities for growth and professional development.
Key Responsibilities:
- Client Representation: Advocate for clients involved in a variety of disputes, including beneficiaries, heirs, personal representatives, trustees, and other interested parties in various matters under A.R.S. Titles 14, 36 and 46, including guardianship, conservatorship, will/trust contests, fiduciary misconduct, powers of attorney, burial/disposition of remans, elder abuse, neglect and financial exploitation, creditor’s claims and a wide variety of other matters.
- Client Counseling: Provide guidance and advice throughout the litigation process, explaining legal options, potential risks, and benefits.
- Client Communication: Ensure clients are informed about the status of their matters, upcoming events, necessary tasks, and strategies.
- Case Evaluation and Strategy: Assess the merits of cases and develop legal strategies based on specific circumstances, analyzing relevant documents and applicable laws.
- Deadlines Management: Ascertain and meet deadlines applicable to assigned matters.
- Filing and Responding to Pleadings: Draft and file legal documents, including complaints, petitions, motions, and responses.
- Discovery: Conduct discovery to gather evidence, including requesting documents, serving interrogatories, taking depositions, and issuing subpoenas.
- Legal Research: Conduct thorough research on case law, statutes, and legal precedents.
- Negotiation and Mediation: Attempt to resolve disputes through negotiation or alternative dispute resolution methods.
- Courtroom Representation: Represent clients in probate court proceedings, presenting oral arguments, examining witnesses, and introducing evidence.
- Trial Preparation and Litigation: Prepare meticulously for trial, organizing evidence and developing persuasive arguments.
- Appeals: Handle the appeals process if necessary, reviewing trial records and drafting appellate briefs.
Qualifications:
- Experience: Will train a recent law graduate who is motivated and wants to be challenged, to learn and grow with the firm. Or we will also welcome someone with experience in estate planning and/or litigation, preferably in probate, trust, estate, guardianship, conservatorship, or vulnerable adult litigation and train them as well.
- Education: Juris Doctor degree from an accredited law school and, if not already licensed in Arizona, scheduled to take the July 2024 Arizona bar exam.
- License: Arizona license to practice law (required for attorney position).
- Skills: Strong analytical, negotiation, and advocacy skills. Proficiency in Microsoft Office and legal research tools. Excellent organizational and communication skills. Desire for a challenge and to help people in difficult situations, with the corresponding reward of making unfortunate situations better.
